Cumhurbaşkanının Yargı Organlarına Yaptığı Atamaların Yargı Bağımsızlığı Açısından İncelenmesi

Türkiye’de Cumhurbaşkanlığı Sistemi’ne geçişle birlikte geçmişte anayasa ile parlamenter sisteme göre dizayn edilmiş olan yargı bağımsızlığı ile ilgili farklı durumlar görülmeye başlanmıştır. Sistem değişikliği ile yargının bağımsız olmasının yanı sıra tarafsız olma gerekliliği anayasa metinlerinde vurgulanmıştır. Cumhurbaşkanlığı makamının etki alanının genişlemesiyle tüm alanlarda olduğu gibi yargı alanındaki yargı organlarına yapılan atamalarında özellikle yargı bağımsızlığı açısından yeniden değerlendirilmesi olağan bir durum olarak karşımıza çıkmaktadır. Bu çalışmada yargı bağımsızlığı ve kuvvetler ayrılığı kavramları açıklanmaya çalışılmakla birlikte cumhurbaşkanlığı makamının yargı organlarına yapabildiği atamaların temel anlayışı ortaya konmaya çalışılmıştır. Yüksek yargı organları olan Anayasa Mahkemesi, Danıştay, Yargıtay’a yapılan atamaların yasal zemini ve yeni sistemle birlikte bu yasal zeminde öngörülebilecek değişiklikler üzerinde durulmakta olup, hakimler ve savcıların bağımsız ve teminatlı olabilmeleri adına Hakimler Savcılar Kurulu üyelerinin seçimi değerlendirilmektedir.

Examination of the Appointments of the President to Judicial Bodies in Terms of Judicial Independence

According to a parliamentary system with a presidential system in Turkey in the past with the transition to constitutional different situations related to the independence of the judiciary, which has been designed to be seen. Besides the independence of the judiciary with the change of system, the necessity of being neutral is emphasized in the constitutional texts. With the expansion of the sphere of influence of the Presidency, it is usual to reassess the judiciary in terms of the independence of the judiciary in appointments to the judicial bodies in the judiciary. In this study, the concepts of independence of the judiciary and separation of powers are tried to be explained, but the basic understanding of the appointments that the presidential authority can make to the judicial organs is tried to be revealed. The legal basis of the appointments to the Supreme Court, the Supreme Court, the Council of State, the Supreme Court and the changes that can be envisaged on this legal basis with the new system are considered and the selection of the members of the Council of Judges and Prosecutors is evaluated in order to ensure that the judges and prosecutors are independent and secured.
